We want music by Bor Mee Jai and projects under Bor Mee Jai to be played, sung, danced to, remixed, reinterpreted, and creatively reused.

Creators, DJs, musicians, and performers may use songs expressly identified as being covered by this License, subject to the terms below.

This License applies only to songs and assets expressly released under it, and only to rights that Bor Mee Jai owns or is authorized to license.

• Create Remixes, Bootlegs, Mashups, or Rearrangements for social media and Creator-controlled channels
• Sing or perform Covers and create Performance Videos
• Use the music in TikTok, YouTube, YouTube Shorts, Instagram, Facebook, Streams, Vlogs, Reactions, Gameplay, Memes, and other UGC
• Enable monetization on Creator channels or platforms
• Receive Donations, Tips, or Membership revenue
• DJs may use the Original Song or Remixes in paid or unpaid performances
• Perform the music live at clubs, festivals, ticketed events, universities, schools, community events, and similar venues
• Publish clips or recordings from live performances and monetize them
• Use the music in student, educational, and community projects subject to the License

Where reasonably possible, credit the Original Song and original Artist/Project.

These permitted uses may generate revenue.

Platform advertising revenue, Creator monetization, DJ fees, performance fees, ticket revenue, Donations, Tips, or Memberships do not by themselves turn an otherwise permitted use into a Commercial Music Release.

! Prior Permission Required

Please contact us before:

• Releasing a Cover, Remix, Mashup, Rearrangement, or work using Stems as a Commercial Music Release on Spotify, Apple Music, YouTube Music, Amazon Music, Tidal, Deezer, or another streaming/digital music service
• Releasing music through a Digital Distributor or Aggregator
• Releasing the work as an Album, EP, Single, Compilation, CD, Vinyl, or other commercial music product
• Creating an Official Remix or Official Cover
• Releasing or distributing the work through a record label, company, or organization
• Using the music in films, series, drama, television programs, streaming productions, or commercial documentaries
• Using the music as an Official Soundtrack
• Using the music in advertising, Branded Content, Sponsored Campaigns, or Corporate Promotion
• Embedding the music in games, applications, software, interactive products, or other commercial products
• Sampling the Original Song or using Stems in a commercial release by a record label, company, or organization
• Acquiring, licensing, or distributing a Remix/Cover as part of a commercial production or organizational project

The Commercial Music Release requirement applies even when the Creator is an independent artist releasing the work under their own name.

Using a Distributor or Aggregator only to deliver the work to Spotify, Apple Music, YouTube Music, or another DSP still counts as a Commercial Music Release and therefore requires prior permission.

Important: Publishing a Cover or Remix as a video on your own YouTube or social-media channel is not the same as releasing that work as a separate music release on YouTube Music through a Distributor.

A monetized Creator video may remain permitted under this License.

A distributed music release requires prior permission.

Prior permission does not automatically mean that a fee will be charged.

Depending on the project, permission may be:

• Granted without a fee
• Subject to a licensing fee
• Subject to revenue sharing
• Subject to additional conditions or agreements
• Declined on a case-by-case basis

You may not:

• Claim ownership of the Original Master, lyrics, melody, arrangement, or original Stems
• Register the Original Song, Master Recording, Stems, Remix, Cover, Mashup, Sample, or other Adapted Work in YouTube Content ID, Meta Rights Manager, TikTok rights-management systems, audio fingerprinting, or another automated claiming system
• Issue or maintain Claims, Copyright Strikes, or Takedowns against Bor Mee Jai, the original rights holder, or another authorized Creator
• Re-upload the full Original Song with little or no meaningful creative contribution
• Re-upload the original Music Video
• Upload the full Original Song using only a still image, cover art, or similarly minimal change
• Create a channel, playlist, or library whose primary purpose is to republish Bor Mee Jai Original Songs
• Sell, rent, redistribute, or provide the original Stems from your own download location
• Create Sample Packs, Vocal Packs, Loop Packs, Voice Models, Voice Clones, or Training Datasets from the Stems
• Use the Stems to create or provide a generative-audio or voice-model service
• Present a work as an Official Release, Official Remix, Official Cover, Official Collaboration, or Bor Mee Jai-approved work without prior permission
• Use an Artist's or Project's name, logo, image, likeness, or identity in a way that falsely suggests endorsement, partnership, sponsorship, or official collaboration
• Claim exclusive rights over the original melody, lyrics, Stems, or source elements
• Prevent other authorized Creators from creating Remixes or Covers of the same Original Song
• Sell, transfer, or sublicense rights that you do not own

Content ID and Automated Claims

Creators using music under this License must not register their Remix, Cover, Mashup, or other Adapted Work in an automated claiming system when it contains elements from the Original Song or Stems.

This includes systems such as:

• YouTube Content ID
• Meta Rights Manager
• TikTok rights-management systems
• Audio Fingerprinting services
• Distributor music-detection systems
• Similar automated Claim, Monetization, Blocking, or Takedown systems

This rule applies even if your Adapted Work contains substantial new music, vocals, production, or other original material.

The reason is simple:

an automated claim registered by one Creator could incorrectly claim the Original Release or another Creator who is also legally using the same music under this License.

If your Distributor, Aggregator, or platform enables Content ID or another automated claiming system by default, you must opt out, disable it, or ask the provider to remove the reference asset.

If an accidental Claim occurs, you are responsible for promptly releasing the Claim and taking reasonable steps to prevent further automated Claims.

Monetization Is Allowed — Within the Permitted Uses

We do not want Creator monetization by itself to prevent people from using the music.

When the underlying use is permitted by this License, you may generally earn revenue from:

• Automatic platform advertising
• YouTube or social-platform monetization
• Donations
• Tips
• Memberships
• DJ fees
• Performer fees
• Ticketed-event revenue
• Live-stream or live-performance revenue
• Remix, Cover, or Performance Videos
• Student or Creator competition prizes
• Ordinary production fees paid to editors, dancers, musicians, videographers, or other Creator collaborators

Receiving revenue does not automatically make the use a prohibited commercial use.

However:

Monetization does not override the Prior Permission section.

A Commercial Music Release, Branded Content campaign, Advertisement, Official Release, film/series use, commercial game/app use, or other reserved commercial use still requires prior permission.

Branded Content and Sponsored Work

Ordinary Creator content that receives automatic platform advertising revenue is not automatically Branded Content.

However, if a Creator receives money, products, services, discounts, free goods, sponsorship, or another benefit from a brand or commercial client to create content using the music, that use is considered Branded Content and requires prior permission.

For example:

• A normal monetized YouTube video using the music may be permitted
• A video commissioned by a brand to promote its product using the music requires permission
• A normal Creator post may be permitted
• A Sponsored Campaign using the song as part of the campaign requires permission

Live Performance and DJ Use

DJs, singers, musicians, artists, and performers may use the Original Song or an authorized Adapted Work in live performances without requesting case-by-case permission from Bor Mee Jai.

This includes:

• Paid performances
• Ticketed events
• Clubs
• Entertainment venues
• Music festivals
• University or school events
• Community events
• Private events
• Company events where the music is performed live
• Live-streamed performances

Bor Mee Jai does not claim a share of the DJ's or performer's fee under this License.

However, venues, event organizers, broadcasters, platforms, or collective-management organizations may have their own legal or licensing obligations.

This License does not waive those separate obligations.

A live performance at a branded event may be permitted, but using the song in the advertising, promotional video, campaign media, or Branded Content for that event still requires prior permission.

Student, Educational, and Community Projects

The music may be used without prior permission in:

• Student short films
• School projects
• University projects
• Presentations
• Research
• School or university clubs and events
• Community projects
• Charity or nonprofit projects
• Student competitions or festivals

If a student or community project is later acquired, financed, distributed, reproduced, or developed commercially by a film company, television network, streaming platform, record label, brand, or another commercial organization, additional permission is required before that commercial use.

Suggested Credit

For a Remix or Cover:

Original Song: "[Song Title]" by "[Artist/Project]"
Unofficial Remix / Cover by: "[Creator Name]"
Used under the Bor Mee Jai Free Creator & Performance License.

For ordinary UGC that is not a Remix or Cover, a shorter credit may be used:

Music: "[Song Title]" — [Artist/Project]
Used under the Bor Mee Jai Free Creator & Performance License.

Credits should be placed in a Description, Caption, End Credit, Metadata field, or another reasonably visible location appropriate to the platform.

Credits must not imply that Bor Mee Jai or the original Artist endorsed, sponsored, co-produced, or officially collaborated on the Adapted Work.
